The first human need for life is a house and a home. Population growth and reverse migration to villages are directly proportional to the rapid population growth in towns and cause their development in both horizontal and vertical ways (increasing density). Districts, as the first custodians of management over settlements, face heavy duties and many problems in the growth and development of villages. One of the challenges of villages is unauthorized and unprincipled construction, which has a very negative impact on the structure of settlements. The motivations for construction violations in villages include the old and ineffective laws, inflation, lack of proper planning by government officials in the construction of national housing, and the excessive increase in the price of land and construction materials in the last decade. (Sharifi et al., 2024) The Commission of Article 99 of the Municipality Law, as a quasi-judicial institution, is the authority that investigates construction violations that have occurred outside the approved area and the boundaries of cities. The purpose of forming this commission is to prevent unauthorized construction outside the approved boundaries of cities and to deal with violations in these areas. The decisions issued by this quasi-judicial body are only two: 1- demolition of the building 2- fines. (Shokri and Iranshahi, 2025) The competence of this commission as one of the authorities to deal with construction violations is one of the vital issues in the field of urban and rural law, especially since the legislator has assigned the responsibility of dealing with these violations outside the boundaries of cities to this commission. The main purpose of forming the Article 99 Commission is to maintain urban and rural order and balance and prevent and hinder unauthorized and illegal development, both within and outside the boundaries of cities. (Aminzadeh and Shairi, 2025)
